کلیات این طرح روز ۲۵ مرداد ۱۴۰۵ در مجلس شورای اسلامی تصویب شد. با این حال، بررسی جزئیات و مواد آن همچنان ادامه دارد.
خانه هنرمندان ایران در این بیانیه بر آزادی بیان و حق انتشار اندیشه هنرمندان تأکید کرده است. این مجموعه همچنین آثار هنری را بخشی از زندگی حرفهای و معیشت هنرمندان دانسته است.
حمایت خانه هنرمندان از خانه سینما
انجمنهای عضو خانه هنرمندان اعلام کردند که با موضع خانه سینما درباره این طرح همراه هستند.
در بخشی از بیانیه آمده است که هنرمندان با خلق آثار خود، اندیشه و دیدگاهشان را بیان میکنند. از نظر امضاکنندگان، این فعالیت باید در فضایی امن و آزاد ادامه پیدا کند.
همچنین در این بیانیه به اصل بیستوچهارم قانون اساسی اشاره شده است. انجمنها بر این اساس، آزادی انتشار افکار را از حقوق شهروندان و هنرمندان دانستهاند.
خانه هنرمندان در ادامه تأکید کرده است که تولید آثار هنری تنها یک فعالیت فرهنگی نیست. به گفته این مجموعه، زندگی و معیشت بسیاری از هنرمندان نیز به تولید و انتشار همین آثار وابسته است.
خانه سینما چه اعتراضی داشت؟
خانه سینما پیشتر در بیانیهای نسبت به برخی بخشهای این طرح اعتراض کرده بود.
این نهاد صنفی معتقد است بعضی مفاد طرح میتواند بر فعالیتهای فرهنگی و هنری اثر بگذارد. حوزههایی مانند سینما، سریال، مستند، تئاتر، موسیقی و کتاب از جمله موارد مورد اشاره خانه سینما بودهاند.
یکی از محورهای اصلی اعتراض، استفاده از تعابیری بود که از نظر خانه سینما تعریف حقوقی روشنی ندارند.
برای نمونه، این نهاد درباره عباراتی مانند ارائه «چهره سیاه از ایران» ابراز نگرانی کرده است. خانه سینما معتقد است چنین تعابیری ممکن است در تفسیر و اجرای قانون ابهام ایجاد کنند.
به همین دلیل، این نهاد صنفی خواستار توجه بیشتر به حقوق هنرمندان و ویژگیهای فعالیتهای فرهنگی شده است.
مجلس چه چیزی تصویب کرده است؟
نمایندگان مجلس روز ۲۵ مرداد با کلیات طرح «مقابله با نفوذ سرویسهای اطلاعاتی و دولتها یا نهادهای بیگانه در کشور» موافقت کردند.
۱۸۳ نماینده به کلیات طرح رأی موافق دادند. همچنین چهار نماینده رأی مخالف و پنج نماینده رأی ممتنع دادند.
بنابراین، این طرح هنوز به قانون نهایی تبدیل نشده است. مجلس پس از تصویب کلیات، بررسی مواد و جزئیات آن را آغاز کرده است.
متن در حال بررسی شامل ۳۳ ماده است. در نتیجه، امکان تغییر برخی مواد در جریان بررسی مجلس وجود دارد.
دلیل تدوین طرح از نگاه مجلس
حامیان طرح میگویند هدف آن ایجاد چارچوب قانونی مشخص برای مقابله با نفوذ است.
حسن قشقاوی، سخنگوی کمیسیون امنیت ملی و سیاست خارجی مجلس، پیشتر اعلام کرده بود که قوانین موجود موضوع جاسوسی را پوشش میدهند. با این حال، از نگاه تدوینکنندگان طرح، در زمینه «نفوذ» خلأ قانونی وجود دارد.
بر همین اساس، طراحان میگویند این طرح برای شناسایی، پیشگیری و مقابله با نفوذ تدوین شده است.
واکنش جامعه هنری ادامه دارد
بیانیه خانه هنرمندان تازهترین واکنش یک نهاد فرهنگی به این طرح است.
پیش از این، خانه سینما نیز نسبت به پیامدهای احتمالی برخی مواد طرح برای سینماگران و هنرمندان هشدار داده بود.
اکنون انجمنهای عضو خانه هنرمندان نیز به این موضع پیوستهاند. آنها خواستار توجه بیشتر قانونگذاران به شرایط فعالیتهای فرهنگی و هنری شدهاند.
با ادامه بررسی طرح در مجلس، متن نهایی مواد مرتبط با سینما، هنر و رسانه اهمیت بیشتری پیدا خواهد کرد. نتیجه این بررسیها مشخص میکند که چه تغییراتی در نسخه نهایی طرح اعمال خواهد شد.
Iran Artists Forum Associations Object to Parliament’s Proposed Bill
Faranemaa reports that associations affiliated with the Iran Artists Forum have issued a statement expressing opposition to the proposed “Plan to Counter the Infiltration of Foreign Intelligence Services, Governments and Institutions,” while also declaring their support for an earlier statement issued by the Iranian House of Cinema.
The general outlines of the bill were approved by the Iranian Parliament on August 16, 2026, corresponding to 25 Mordad 1405. Several provisions of the proposal have since drawn criticism from cultural and artistic organizations over their potential implications for artistic activity and freedom of expression.
In their statement, the associations affiliated with the Iran Artists Forum (Khaneh Honarmandan Iran) emphasized artists’ right to express and publish their ideas and referred to Article 24 of the Constitution of the Islamic Republic of Iran.
They argued that works of art are the product of artists’ thoughts and creativity and are also directly connected to their professional lives and livelihoods.
Support for the Iranian House of Cinema
The Iran Artists Forum said it supported the position previously expressed by the Iranian House of Cinema (Khaneh Cinema) and voiced concern about the potential consequences of the parliamentary proposal for cultural and artistic activities.
The statement describes artists as people who contribute to society through the creation of works based on truth, thought and cultural values.
It also emphasizes that artistic production is not merely a form of expression but constitutes a central part of artists’ professional and economic lives.
What Did the House of Cinema Say?
The Iranian House of Cinema had issued its own statement on August 19, expressing concern over parts of the proposed legislation that it said could affect cultural and artistic activities including film, television series, documentaries, theater, music and books.
One of its central objections concerned language related to works that allegedly present a “dark image of Iran.”
The House of Cinema argued that the absence of a clear legal definition for such concepts could leave socially critical or realist works open to varying interpretations by authorities.
The organization also warned that broad criminal provisions could discourage filmmakers and artists from addressing social, historical and political subjects.
Parliament Has Approved the General Outline, Not a Final Law
On August 16, 2026, members of the Iranian Parliament voted in favor of the general outline of the proposal by 183 votes in favor, four against and five abstentions, with 258 members present.
The vote did not complete the legislative process.
Parliament has subsequently continued to examine individual provisions of the proposal. The latest version under consideration contains 33 articles, several of which have already entered parliamentary debate.
Accordingly, the proposal should not yet be described as a finalized and enforceable law.
Hassan Ghashghavi, spokesman for Parliament’s National Security and Foreign Policy Commission, has said that while existing Iranian legislation addresses espionage, the bill’s authors believe there is a legal gap concerning what they define as “infiltration.”
According to supporters of the proposal, the bill is intended to establish a legal framework for identifying, preventing and countering foreign infiltration.
Cultural Reactions Continue
The Iran Artists Forum’s statement follows a growing series of responses from cultural and artistic organizations.
The Iranian House of Cinema was among the major professional bodies to raise concerns specifically about the possible consequences for cinema and artistic production.
The affiliated associations of the Iran Artists Forum have now formally joined that position.
As parliamentary review of the 33-article proposal continues, the final wording of provisions concerning cinema, art, media and cultural activities will determine whether the concerns expressed by artistic organizations remain applicable to the final legislation.
